Nirbhaya Case in 2013
Excerpts from the article published on September 13, 2013
Friday, 13th has never been a reason to feel good about it. It’s a cursed date, but no more. From today onwards, it will be remembered for the landmark judgment given by Additional session judge Yogesh Khanna.
“Besides discussing others offenses, I straightaway come to section 302 (murder) of IPC. This falls under the human nature of the convicts and the gravity of offense they committed cannot be tolerated. The death sentence is given to all the four convicts,” he said.
The offense, committed by Mukesh (26), Akshay Thakur (28), Pawan Gupta (19) and Vinay Sharma (20) falls under the rarest of rare category warranting capital punishment, the judge said.
The four were convicted by the court on September 10 for the gang rape and murder of a 23-year-old paramedic student.
It was the most gruesome, cruel, cold-blooded crime ever committed against a woman. Humanity cried, morals died on that very day. The whole nation was waiting for the verdict with bated breath. The judgment is significant in many ways. It upheld the faith of common man in law & justice. All four convicts deserved nothing less . Keeping in mind the nature of the crime, the death penalty is justified. If not all, it would at least deter some offenders to commit crimes against women.
It is shocking to know that the defense lawyer of one of the convict A P SINGH cried foul. Well MR. Singh, you can have your 5 minutes of fame but it is not going to earn you any brownie points. You shouldn’t have taken the case in the first place. Even if you did, challenging the decision in high court clearly shows that you have no sympathy for the victim, NIRBHAYA, or women folk at large. What were you thinking when you pleaded for mercy. Does that beast deserve even a trace of mercy? You should be ashamed of the actions you have put up & for the crocodile tears you have shed.
The families of convicts are in denial. The reaction was oblivious. In India, If a girl marries against the family’s will, she is disowned & humiliated or at times killed in the name of family honor. On the contrary, if a boy /man comes back home after committing the most inhuman crime, he is supported & protected by family members. Mothers & sisters come out in full support. What a SHAME !!! It is one of the reasons that serial offenders get away so easily every time.
Some activists & countrymen are against death penalty reasons best known to them. I fully support the verdict for many reasons
- Some nut cases like the above four & one ‘juvenile’ can never be reformed.
- If such offenders are given lighter punishments, the fear of law & justice would diminish further.
- A life sentence in our country is for a maximum of 25 years. The convicts, in this case, all are under 25. When they come out after serving the sentence, who is going to ensure that they wouldn’t commit any further crime & won’t be a nuisance for the society.
- I, as an honest taxpayer, don’t want my hard-earned money to be wasted on such animals who have no heart or soul whatsoever. Hang them & get over with it. We already have our hands full with problems & issues.
Finally, justice is delivered in Nirbhaya Case. Don’t know whether to celebrate the victory or be saddened by rising crimes against women . When all said & done, NIRBHAYA, may you rest in peace !!!
